Sandigan junks demurrer requests of ex-Cainta officials in bidding misconduct case

Three former Cainta municipal officials will not be getting off quite yet in relation to the string of graft cases faced by then-mayor Nicanor Felix, this time for overpriced supplies and a P1.4 million scanner.

“After a thorough review of the records of the cases and the evidence submitted by the Prosecution, the Court finds that, if unrebutted, the same is sufficient to support a verdict of guilt,” the Sandiganbayan 6th Division stated in a resolution promulgated Monday.

Former officer-in-charge of General Services Office Marciano Doroteo, budget officer III Glady Formales and municipal budget officer Privada Gonzales were charged with graft for their participation in the purchase of an allegedly overpriced Contex scanner.

In addition, they’re facing counts under the Local Government Code for having business interests in the purchase of miscellaneous supplies without public bidding from Tueance Alera Gentrade Industries, owned by accused Formales and her husband.

In their respective motions, Doroteo, Formales and Gonzales argued the insufficiency of the prosecution’s evidence.

On his end, Doroteo defended the scanner purchase, claiming that the P897,300 price quotation raised by the prosecution is merely a suggested retail price, not he real market value.

Formales, arguing that she wasn’t a member of the municipality’s Bids and Awards Committee, claimed she “had no hand in the procurement process.”

However, the court sided with the prosecution, which stressed that the transactions entered into by the accused were “unjustified.”

Felix has been battling graft allegations from as far back as 2005 for two municipal contracts worth P11.2 million reportedly awarded without public bidding.

In 2015, he was charged again for the purchase of a private lot P14 million, despite being valued four million less.

The resolution was written by Associate Justice Karl Miranda, concurred by Division Chairperson Sarah Jane Fernandez and Associate Justice Kevin Narce Vivero.
