Sandiganbayan refuses to reopen probe on graft case vs. Jun Ynares
The Sandiganbayan 3rd Division has refused to have the Office of the Ombudsman reinvestigate the graft case of former Rizal governor Casimiro Ynares Jr. concerning his involvement in the fertilizer fund scam.
The anti-graft court has issued a resolution which turned down his motion for reconsideration as well as that of his co-accused, former assistant department head Romulo Arcilla Jr., who both insisted that the case undergo reinvestigation.
“If the accused-movants truly believe that the Office of the Ombudsman erred in indicting them in these criminal cases, their remedy is not to ask for a reinvestigation of their case,” the resolution read.
“They should instead immediately proceed to the trial of these criminal cases so that the purported deficiencies in the evidence of the prosecution may be determined at the appropriate time,” it stressed.
The case stemmed from the supply deals with Feshen Philippines which secured a contract to supply a total of 2,455 bottles of fertilizers in 2004 and 2005 amounting to P3.23 million.
However, there were allegedly irregularities found in the deals including the absence of the required public biddings.
