Sandiganbayan junks ex-Batangas rep Gozos’ plea for leave to file demurrer
The Sandiganbayan 2nd Division has junked the motion of former Batangas representative Oscar Gozos who sought leave to file a demurrer to evidence challenging the evidence presented by the prosecution in his graft trial.
“After a careful evaluation of the testimonial and documentary evidence presented by the prosecution, the court is convinced that the same, if unrebutted, is sufficient to sustain the indictment of the accused,” read its resolution.
Because of this, Gozos will have to present his defense during the trial.
Otherwise, Gozos may still file a demurrer to evidence but waives his right to present his defense in the trial.
The case stemmed from the purchase of four units of Tornado shredder chipper machines from LCV Design and Fabrication Corporation under the Department of Agriculture’s (DA) Ginintuang Masaganang Ani program.
