Nueva Ecija town mayor Uera moves to block Sandiganbayan suspension
Pantabagan, Nueva Ecija Mayor Lucio Uera said there was no need for the Sandiganbayan Second Division to grant the Office of the Ombudsman’s request to suspend him from office over graft charges involving the dismissal of municipal employees in 2005.
“Under the current state of affairs in the Municipality of Pantabagan, Nueva Ecija, accused Lucio Uera has ceased to become the incumbent or current mayor of the Municipality,” read the pleading filed by the politiko.
The Department of Interior and Local Government (DILG) sacked Uera in 2015 year over his illegal suspension and termination of 44 municipal employees.
However, Uera never mentioned in his pleading the DILG dismissal order against him.
In his pleading, Uera indicated that Vice Mayor Ruben Huerta, who filed the graft complaints against him, had usurped his post since March 26, 2015.
Uera told the court that Huerta “surreptitiously and forcibly” entered the mayor’s office on October 19, 2016 while government offices were suspended due to the raging typhoon Lando and has occupied the premises since.
Since Uera no longer held the position, he pointed out “the purpose of suspending herein accused from his office pending litigation is mooted.”
“There is no likelihood that accused Uera could intimidate or influence witnesses under his ascendancy as, as shown heretofore, he is not but Vice Mayor Huerta who currently sits and actually performs as Municipal Mayor or Acting Municipal Mayor of Pantabagan, Nueva Ecija,” Uera assured.
