Sandiganbayan asked to uphold indictment of ex-Guv Reyes in fertilizer scam

The Office of the Ombudsman has asked the Sandiganbayan Fifth Division to uphold the graft indictment of former Palawan governor Joel Reyes for his involvement in the fertilizer fund scam.

The Ombudsman has filed a motion asking the anti-graft court to throw out his motion for judicial determination of probable cause which sought the dismissal of the case against him.

Reyes is currently detained over a murder case in connection with the death of broadcaster Gerry Ortega.

The graft case stemmed from the 2004 purchase of 3,240 bottles of fertilizers worth P3.25 million which were bought from Masaganang Ani Para sa Magsasaka Foundation Inc. (MAMFI), a non-government organization known to be controlled by pork barrel scam architect Janet Lim Napoles.

The Ombudsman, which filed the graft case, discovered that the transaction skipped the required public bidding.

Apart from this, the Ombudsman also learned that MAMFI was not qualified to be an accredited project implementer and that it did not submit the complete documents required for accreditation under the rules of the Commission on Audit (COA).

In his motion, Reyes claimed he had no participation in the transaction and that it was the Department of Agriculture (DA) that decided on the kind and amount of fertilizer to be bought.

However, the Ombudsman pointed out Reyes already admitted signing the memorandum of agreement which endorsed MAMFI to implement the project.
