Ex-Mayor Malannag faces malversation case for failure to liquidate ove
Former Pasil, Kalinga Mayor Alfredo Malannag Jr. faces a malversation of public funds case for his failure to liquidate more than P500,000 in cash advances in 2001.
Ombudsman Conchita Carpio Morales has issued a review affirming a resolution of the Kalinga Provincial Prosecutor to have Malannag indicted before the Sandiganbayan
Morales cited that the Commission on Audit (COA) reported that he failed to liquidate his cash advances from July 2001 to September 2001 despite repeated demands.
As of March 2009, the COA indicated that a balance of P503,920.16 remained unliquidated.
“[T]he refunds made by the respondent as itemized in the COA Report strengthen the presumption that he misappropriated such unliquidated cash advances,” Morales pointed out.
Article 217 of the Revised Penal Code which penalizes malversation of public funds provides that “a public officer is accountable for public funds or property from appropriating the same or shall take or misappropriate or shall consent, through abandonment or negligence, shall permit any other person to take such public funds, or property, wholly or partially. “
